Prices 

In general, our prices apply according to our current price list. The prices are exclusive of 10% or exclusive of 20% VAT depending on the type of product. 

 

Terms of Payment 

Our invoices are payable within 14 days less 2% discount or within 30 days without deductions. If the payment date is exceeded, we charge 10% p.a. interest on arrears. 

Payment for products ordered online is made by credit card. 

 

Terms of Delivery 

Delivery is prepaid to the address given by the buyer, provided that the delivery is made by courier or post. In the case of self-collection of fresh products, the buyer is obliged to collect the goods within the expiry date (cookies: 7 working days, cakes: 3 working days). 

 

Warranties 

In the event of a defect, the statutory provisions shall apply. We shall not be liable for any further damage incurred by the purchaser as a result of the defective delivery. 

 

Right of Withdrawal and Cancellation Policy 

We expressly point out that under certain circumstances there is no two-week right of withdrawal despite a distance contract. This applies in particular to goods that are manufactured according to customer specifications, that are clearly tailored to personal needs, that are not suitable for return due to their nature, that can spoil quickly or whose expiry date would be exceeded (§ 5f KSchG). Since our products are fresh products and are made according to customer specifications, in particular biscuits, cupcakes and cakes, revocation is therefore excluded. 

 

Leisure events with fixed dates 

A course booking for a specific date is considered binding as soon as the order process has been successfully completed by the orderer. As this is an event with a fixed date, neither cancellation nor participation in an alternative date is possible. If the person placing the order is unable to attend the course, they are free to send a substitute to take their place. 

 

Packaging 

Our prices include packaging costs. 

 

Retention of Title 

The goods remain our property until full payment has been received. 

 

General Data Protection Regulation (DSGVO)  

All personal data requested during the online ordering process will be deleted immediately after the buyer or an authorised person has accepted the purchased goods/services. The data protection officers of Cup & Cake Ltd. are Petra Steinlechner and Barbara Barger.
